read these conditions carefully before visiting or shopping on the Website. By
visiting or shopping on the Website you (referred to as "you",
"customer", "user" or "buyer") acknowledge and
agree to accept these Terms and Conditions.

The information provided on www.elshisha.com, https://www.facebook.com/elshisha.official/ and https://www.instagram.com/elshisha_official/ has not
been evaluated by the Bulgarian Food Safety Agency (BFSA).   

Smart Creative Group Ltd. takes no liability for misuse of our products and
devices, nor for your reliance on information provided on other websites.

Smart Creative Group Ltd. is not responsible for orders placed outside of the order form on the company's official website www.elshisha.com and confirmed by a phone call.

Smart Creative Group Ltd. is not responsible for orders made by phone call or to subcontractors or other third parties by phone call and/or websites other than www.elshisha.com or through other communication channels and services of the information society.

User account

You must register on the Website in order to shop, to use some
services and to enjoy special promotions and activities.

For safety and security, each customer is allowed to create only
one registered account with a single e-mail. For customers who attempt to
create several accounts with the same e-mail, we reserve the right to suspend
accounts without further notice.

In accordance with Customs regulations customers must provide
valid and accurate data. All consignee names, address and payers name should be
valid. In certain countries the consignee may have to submit their ID or
passport to clear the package or for payment verification purpose. Customers
are solely responsible for the accuracy of data that they provide on the
Website. Should any information be incorrect and prevent any shipment or
deliveries or customs clearance, El Shisha will not be held responsible and
will not offer any compensation in such cases.

El Shisha will always comply with the law, and we kindly remind
users to do the same. As importers the customers are responsible to comply with
all laws and regulations in their own countries.

Ordering

Given the popularity and/or supply constraints of some of the
products offered on the Website, El Shisha may have to limit the number of products
available for purchase. El Shisha reserves the right to change quantities
available for purchase at any time, even after you place an order.

Following order dispatch, transportation is the sole
responsibility of third-party logistics company. During this stage, full
ownership of the product(s) belongs to the buyer (in cases where the products
are prepaid); therefore all associated liability and risks during
transportation shall be borne by the buyer.

Order Cancelation

Customers can cancel their order at
anytime prior to shipping, but only if the products are not already paid for. For

once the order has been dispatched, the order cannot be canceled, changed, or
refunded.

Shipping and Delivery

Shipping times displayed on the
Website refer to the estimated dispatch time of the packages. Since the actual
delivery of your order can be impacted by many events beyond El Shisha's
control we suggest that if customers have a special occasion or event that they
wish to use their item for, such as a birthday, that they order their items
well in advance. El Shisha cannot be held liable for late deliveries. We will,
however, work with you to ensure a smooth shopping experience.

There may be occasions
when El Shisha confirms your order but
subsequently learns that it cannot be supplied to you. In the event El Shisha cannot supply a product you ordered in a timely
fashion, El Shisha will contact customers
and offer to cancel the order and refund the purchase cost in full.

Shipping and delivery times are calculated in working days from
Monday to Friday. In the case of major holidays such as Christmas, Black Friday
etc. please allow extra delivery time.

Customers are responsible for providing complete and accurate
shipping addresses. El Shisha cannot make
changes to your shipping address once a package has been shipped, and El Shisha is not liable for packages lost due
to incomplete or inaccurate addresses.

Should the buyer refuse the package due to import duties or taxes,
the buyer takes full liability for all the costs involved in the process.

All orders reported as "delivered" by shipping companies
are considered delivered. El Shisha cannot be made liable of non-delivery in
this case.

If the address to which the package is sent and other contact
information are the correct address and contact information as provided by the
customer, El Shisha cannot be held liable if a package is returned.

Whatever the customer orders is what will be shipped. We cannot be
held liable for the customer receiving the wrong item if they placed the wrong
order.

Warranty

All El Shisha devices have the standard 3-month battery warranty for this class of devices. In the event of a problem occurring during the warranty period, customers have the right to use free service for their device or replacement of the device, if necessary.

Return Policy

You may return unopened and unused items within 14 days after
delivery for a full refund. The El Shisha company will not be responsible for
the return shipping costs of the items (unless they are defective). Please be
informed that we will refund the products value only, excluding any shipping
costs originally paid! All shipping costs will be at the expense of the
customer unless the products were initially delivered faulty!

If your order arrives damaged or defective in any way please
contact us at [email protected] to arrange
a return. We reserve the right to inspect the product/s and determine whether
or not we consider them to be defective. If we find that they are, you will
receive a full refund or replacement.

Products that are used or with damaged packaging; refillers/cartridges; disposable devices and liquids are not subject to refund for reasons of hygiene and health protection and the possibility they can be compromised or tampered with in any way.

Products that have expired warranty are not subject to return or exchange.

In order to get a refund for a returned product, you must provide a cash receipt or a receipt for the transfer of money when payment is made by cash on delivery.

All bank fees regarding the refund for returned products are entirely at the expense of the recipient.

Products purchased during a campaign or promotion are not subject to return or exchange.

We reserve the right to refuse to accept a return of a product if we believe that the return rules have not been followed.

3. Pursuant to Art. 183/183e. in the event of a dispute, the user should take it directly to the merchant for consideration and the parties should try to resolve it between themselves. If there is a difficulty in solving it, the customer can use the Online Dispute Resolution Platform - ODR

Prices

Prices and availability of items
are subject to change without notice. For international shipments the prices do
not include import tax and duties, should your package become examined and
deemed taxable by your local customs. Payment of these is the responsibility of
the buyer.

Even though El Shisha products help
people quit smoking tobacco products, our company can not guarantee that you
can achieve this goal. El Shisha products are not to be used as remedies,
vitamin or dietary supplements.  If you
have a health condition or concern, consult your health care provider.
